Privacy Policy

Overview

This is the short version. The full policy follows underneath, and it is the version that legally applies.

About us and how to contact us

Embergrove Games Studio (“Embergrove”) makes games you can play for free, and we process your personal information when you play them. If you have a question about our data practices, your rights, or a complaint, contact us at privacy@embergrovegames.com or write to us at the address in section 7.

Personal information we collect

We collect information you give us directly — for example when you create an account or contact support — and we generate information about how you use our games, including gameplay and log data. If you sign in with a third-party account, we receive information from that account. We also receive information from third parties such as analytics and advertising providers.

How we use your personal information

We use it to run our games, to support you, to understand and improve how the games are played, and to answer your questions. We sometimes send push notifications and show you ads that may be tailored to you. You can turn both off at any time in the game settings or in your device settings.

Who we share your personal information with

We rely on third parties to run the games — hosting, support ticketing, analytics — and we work with advertising partners to show you ads. We also share information within our own group of companies and where the law requires it.

Where we process your personal information

Your information is processed by us and our service providers in several countries, including within the European Economic Area, the United Kingdom and the United States.

Your rights

You may have the right to access your information, receive a copy of it, correct it, delete it or restrict how we use it, and to object to certain uses including tailored advertising.

Changes to this policy

Any updates are published on this page. If a change is significant, we will also tell you in-game.

Introduction

This privacy policy (the “Policy”) explains our practices and your choices in relation to your Information (as defined below). In this Policy, “Embergrove”, “we” or “us” means Embergrove Games Studio, registered at [registered office address] under company number [company number]. We decide why your Information is needed and how it is used, which makes us the data controller in certain countries.

For the purposes of this Policy, “Information” means any information relating to an identified or identifiable individual. This includes information relating to your use of our mobile and PC games (the “Games”). When you play the Games you accept the rules and policies that set out how we handle your Information, and you understand that we collect, process, use and store your Information as described here. If you do not agree with this Policy, please do not play the Games. If you change your mind later, stop playing and you may exercise the rights set out in this Policy.

1. Personal information we collect

We process and use the following Information about you.

Information you provide to us

  • Account information: a profile name, an avatar and your preferred language.
  • Information collected via our support channels: when you contact our support team we ask for (a) your name, username and email address, and (b) anything else you choose to share so we can help — game ID, team or club name, device brand and model, advertising ID, transaction records or device language.
  • In-game communication: some Games let you interact with other players through chat. Where that happens we process information about those interactions, including timestamps and message content. Some of these features are provided by third parties, in which case we may not have access to the content itself.

Information we collect or generate automatically when you play

  • Identifiers: IP address, advertising ID, HTTP headers, device ID, third-party app IDs, a unique Embergrove ID, country- and city-level location data, and device information such as model, brand, language and operating system.
  • Information about your use of the Games: game ID, install and uninstall timestamps, timestamps of game events, session length, scores achieved, interactions with our team, engagement with advertising and promotions, transaction records, and evidence of cheating software or modified builds of the Games.

Information we receive from third parties

  • Registration through a third party: when you register using an account from a third party (for example Apple, Google, Meta or Steam) we receive your third-party ID.
  • Payment providers: when you buy something in a Game we receive the transaction ID, country, payment provider used, item purchased, currency, value and payment timestamp.
  • Analytics information: we integrate analytics software from third-party providers in some Games. The reports we receive include a user ID and information about in-game activity, and help us tune features and events.
  • Advertising partners: we receive information from third-party advertising providers, including a user ID and information about how you interacted with ads shown in our Games.
  • Mobile measurement partners: we receive information that lets us measure the performance of our marketing campaigns and detect fraud in them, including advertising ID, IP address, location and transaction information.

Children

Our Games are not targeted at people under the age of 18 (a “Child”). If you are a Child, we recommend you get permission from a parent or legal guardian before playing, and that you read this Policy together so they can explain anything that is unclear. If you are a parent with questions or concerns about your Child's use of our Games, contact us using the details in section 7.

2. How we use your personal information

We use your Information to:

  • Provide you with the Games: we perform our contract with you so you can create an account, play the Games (including as a guest), keep your progress, play with friends and chat in-game. We also use it to let you make purchases and to keep a record of them. This involves your registration information, identifiers, information you generate while playing and information about your use of the Games.
  • Improve and monitor how the Games are used: it is in our legitimate interests to make our Games better. To do that we collect or generate information about how you play, along with device information such as battery level, network strength, manufacturer, model, operating system and available storage.
  • Support you and respond to requests or complaints: if you contact us we use your Information to open a support record, resolve your query and help with things like recovering an account. This is part of our contract with you.
  • Conduct analytics: it is in our legitimate interests to analyse how our Games and campaigns perform. We use the information we collect or generate to (a) create anonymised and aggregated data, (b) build segments of players who share characteristics or interests, and (c) carry out predictive analysis about what you may enjoy.
  • Tell you about in-game offers: we show promotional offers and information about virtual items available in a Game, tailored to you based on gameplay, region, device data and in-game interactions.
  • Show you advertising: we present ads and suggestions in our Games and elsewhere, which may relate to our own Games or to other products you may be interested in, and which may be tailored to you. Where consent is required we ask for it first; where it is not required, or where the advertising is contextual, we rely on our legitimate interests. You can withdraw consent at any time in the Game settings where that option is available.
  • Prevent fraud, defend our rights and meet our legal obligations: it is in our legitimate interests to protect players from abuse and other anti-social or illegal behaviour, to detect activity that undermines the integrity of our Games, to remedy it, to defend ourselves against claims or disputes, and to enforce our terms and policies.

3. Who we share your personal information with

We share your Information with selected third parties:

  • Other players: other players see your profile information and in-game activity, plus anything else you choose to share with them, such as chat messages.
  • Vendors and service providers: including cloud providers who host our data and game servers, customer support platforms that help us manage and answer your questions, and analytics, segmentation and mobile measurement providers who help us understand our player base.
  • User acquisition partners: we work with partners who help us measure how our marketing campaigns perform. This may include custom and lookalike audience programmes, where we provide an identifier such as your advertising ID so a partner can tell whether you already hold an account with them, and our ads may then appear when you visit their services. Our partners are listed below.
  • Advertising partners: our Games are supported by advertising. Subject to your settings, we provide certain Information to advertisers who serve ads in our Games, and we measure who sees and clicks them. We also share advertising identifiers along with interests or other characteristics of a device, so partners can decide whether to serve an ad to that device and carry out brand analysis and personalisation. Our partners are listed below.
  • Payment processors: we use the payment systems of the platform you play on — Google Play on Android, or the Apple App Store on iOS. These providers are responsible for processing your payment information and may use it for their own purposes under their own policies. For Apple, see the App Store & Privacy notice on your device. For Google, see policies.google.com/privacy.
  • Companies in the same group as Embergrove: we share Information with other entities in our group of companies.
  • Law enforcement, public authorities and courts: we disclose Information where we are legally required to, or where we reasonably believe it is necessary to comply with a legal obligation or request; to enforce our terms and other policies, including investigating potential breaches; to detect, prevent or address security, fraud or technical issues; or to protect the rights, property or safety of Embergrove, our players, a third party or the public.
  • Change of corporate ownership: if we are involved in a merger, acquisition, insolvency, reorganisation, partnership, sale of assets or similar transaction, we may disclose your Information as part of it.

Third-party privacy practices

If you access a Game through a third-party platform (a “Third-Party Service”), that platform may collect information about you — including information you share with it directly and information about how you use the Game — under its own terms and privacy policy. The practices described in this Policy do not apply to Third-Party Services, and any link to one in a Game does not mean we endorse or have reviewed it.

Security

We have security measures in place to protect the privacy and integrity of your Information, but transmitting information over the internet is never completely secure. We also take steps to minimise the Information we hold — for example, passwords you provide during registration are stored as a one-way hash rather than as text we can read.

4. Where we process your personal information

We process your Information in several countries, including countries inside the European Economic Area (the “EEA”), the United Kingdom (the “UK”), the United States of America and others.

When we transfer your Information outside the UK or the EEA, we may transfer it to a country recognised by the UK or the EEA as offering adequate protection. Where that recognition does not exist, we use the standard contractual clauses approved for use in the UK or the EEA to safeguard your Information during the transfer.

5. How long we store your information

We keep your Information for as long as you are registered or playing our Games, and then for up to three years from the date you last interacted with them.

When we delete Information we take steps to make it irrecoverable and irreproducible, and electronic files containing it are deleted permanently.

6. Your rights

If you are based in the EEA, the UK, Switzerland or Brazil, or you are a legal resident of California, you have certain rights in relation to your Information. California residents should also read Addendum 1 below.

To exercise any of these rights, email us at privacy@embergrovegames.com with enough detail for us to identify your account.

  • Access: you can ask for a copy of your Information, together with an explanation of how we use it and who we share it with. This right is not absolute — for example, we cannot disclose trade secrets or information about other people.
  • Erasure: you can ask us to delete your Information. We may need to keep some of it where there are valid grounds under data protection law — for example to defend legal claims or where we have an overriding legitimate interest — and we will tell you when that is the case. Where Information is held by a separate controller such as an advertising partner or payment processor, we will take reasonable steps to pass on your request, but we recommend contacting them directly as well.
  • Objection and withdrawal of consent: you can withdraw consent you previously gave, or object to processing we carry out on the basis of our legitimate interests. In practice: to stop personalised advertising, opt out in the in-game settings; to stop marketing emails, use the unsubscribe link at the bottom of any email; to stop push notifications, change your device or browser settings.
  • Portability: you can ask for a copy of the Information we process on the basis of consent or contract in a structured, commonly used, machine-readable format, or ask us to transfer it to another provider.
  • Correction: you can ask us to correct Information we hold about you that is inaccurate.
  • Restriction: in certain circumstances you can ask us to stop processing your Information other than to store it.

7. Contact and complaints

We welcome questions, comments and requests about this Policy. Please send them to privacy@embergrovegames.com, or write to us at Data Protection, Embergrove Games Studio, [registered office address].

If you want to make a complaint about how we process your Information, contact us at privacy@embergrovegames.com and we will deal with it as quickly as we can. This does not affect your right to complain to a data protection authority.

8. Changes

Any updates or changes to this Policy are published on this page. If a change is significant, we will also notify you in-game.

Addendum 1 — California privacy rights

This addendum applies to residents of California under the California Consumer Privacy Act of 2018 (California Civil Code §§ 1798.100 to 1798.199) and its implementing regulations, as amended or superseded (the “CCPA”). For the purposes of this addendum, Personal Information means information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or household, or as otherwise defined by the CCPA. It does not include information that is lawfully available from government records, deidentified or aggregated, or otherwise outside the scope of the CCPA.

Collection and disclosure of personal information

Over the past 12 months, through your use of the Games, we may have collected and disclosed the following categories of Personal Information:

  • Identifiers: name, email address, IP address, device identifiers, advertising ID, Embergrove ID and profile images. Collected from you or your device. If you registered through a third-party account, we may also have received your third-party ID, name and avatar from that service.
  • Internet or other electronic network activity information: your use of in-game features and events, information about your in-game activity, and information about how you interacted with advertising shown in our Games. Collected from our analytics providers and advertising partners.
  • Geolocation data: city-level location data. Collected from you or your device, and from third-party services when you register through them.
  • Commercial information: records of items purchased, obtained or considered, and the account or region identifiers our payment processors provide. Collected from you or your device and from those processors.

In the preceding twelve months, we collected Personal Information from these categories of sources: you and your devices directly; advertising networks and other advertising partners; analytics providers; and social networks, to the extent this applies to you and within the limits of the permissions you gave.

We collect Personal Information in order to:

  • operate and administer the Games;
  • improve the Games;
  • communicate with you;
  • serve advertising;
  • maintain security and carry out verification, including preventing and detecting fraudulent activity; and
  • address and remediate technical issues and bugs.

For more detail on what each type of Personal Information is used for, see section 2 above.

We may disclose Personal Information to:

  • other players, who see your profile information and in-game activity as well as anything else you choose to share, such as chat messages;
  • affiliated companies in our group who process Personal Information in order to operate the Games;
  • marketing and advertising partners who use it to serve you ads in the Games and elsewhere;
  • other companies providing services on our behalf, who are contractually prohibited from retaining, using or disclosing Personal Information for any purpose other than providing those services to us;
  • regulators, judicial authorities and law enforcement; and
  • entities that acquire all or substantially all of our business.

For more detail on how we disclose Personal Information, see section 3 above.

Sales of personal information and your right to opt out

Over the past 12 months we have used third-party advertising and other tracking technologies in our Games to collect information about you, your devices and your use of the Games, and we have shared that information with selected third parties such as advertising partners who use it to target advertising to you online.

You can opt out and control the use of these technologies at any time through the in-game privacy settings, or by emailing us at privacy@embergrovegames.com.

Rights under the CCPA

The CCPA gives California residents certain rights. These rights are not absolute and are subject to exemptions. Where no exemption applies, you have the right to:

  • submit a verifiable request for the following information covering the 12 months before your request: the categories of Personal Information we collected, sold or disclosed about you; the categories of sources it came from; the purpose for collecting or selling it; the categories of third parties to whom we disclosed it, what was disclosed and why; and the specific pieces of Personal Information we collected about you;
  • submit a verifiable request that we delete Personal Information we collected from you; and
  • be free from unlawful discrimination for exercising your rights, including receiving a different level or quality of service, subject to certain limitations.

We aim to fulfil verified requests within 45 days as required by the CCPA. If we need an extension of a further 45 days, we will explain why.

How to exercise your rights

Email us at privacy@embergrovegames.com. To update your advertising preferences, use the privacy settings inside the relevant Game.

Verification

Requests to access or delete Personal Information, whether made by you or an authorised agent, depend on our ability to reasonably verify your identity in light of what is being requested and in line with the CCPA. Please be ready to give us identifying details — such as your user ID or in-game name — that we can match against our records to confirm you are the account holder.

Authorising an agent

To authorise an agent to make a request to know, delete or opt out on your behalf, email us at privacy@embergrovegames.com.

Shine the Light

We do not rent, sell or share Personal Information with non-affiliated companies for their own direct marketing purposes as contemplated by California's “Shine the Light” law (Civil Code § 1798.83), unless you give us permission.

Do Not Track

There is no accepted standard for how to respond to Do Not Track signals, and we do not respond to them.
